Please have a read through this example Hire Agreement. When you hire a bouncy castle from us without asking us to provide staffing, you are agreeing to comply with these terms, and we will ask you to sign the agreement before anyone uses the bouncy castle.

Hire Agreement and Disclaimer

 

This document forms a contract between Tamworth Inflatables and ______________________, hereinafter referred to as “The Hirer”.

 

Our Responsibilities to the Hirer

As the supplier/erector, and in order to ensure that we comply with our Public Liability Insurance requirements we will ensure:

·         All anchor points are intact and not damaged

·         All anchor ropes are not worn or chaffed

·         All anchor stakes and their locations remain sound for continued use

·         All anchor stakes will be clearly marked to minimise risk of tripping

·         The wall to tower fixings are not torn

·         There are no holes or rips in the surface or seams of the bed and step/front apron

·         When fully inflated all walls and towers (when fitted) are firm and upright and the pressure in the bed and stop/front apron are sufficient to give a reliable and firm footing

·         The blower has no exposed wires or loose bolts/screws and that the mesh guards over the air inlet are secure and intact

·         Electric cables are not worn or chaffed and that plugs, sockets and switches are not damaged

·         All electricity cables will be connected to a RCD device at the mains socket

 

Tamworth Inflatables cannot be held responsible for any damage caused to your property whilst setting up/collecting our inflatables

 

Tamworth Inflatables cannot be held responsible for any holes left in the garden caused by the anchor pegs, although these will be minimal

 

Tamworth Inflatables cannot be held responsible for any damage to underground pipes, cables, plants, ornaments etc.

 

In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings

 

 

 

The Hirer’s Responsibilities

 

HIRE TERMS

·         No deposit shall be required prior to delivery of the equipment

 

·         The hire period shall be from ____________ to ____________ on ____________________

 

·         The hirer shall be required to provide proof of identity and address at the time of setting up the equipment. This will only be accepted in the form of Driving Licence, Utility Bill or Passport.

 

·         Any delays with regards to meeting the client after the contracted arrival time will be charged at an additional £10 per fifteen minutes or part thereof waiting time incurred

·         Any obstruction by the hirer or their guests causing unnecessary delay at collection of the equipment will be charged at £10 per fifteen minutes or part thereof, this also applies where ball pit balls are not bagged and ready for collection

·         Any damage or excessive dirtiness caused to the equipment during the hire period shall be charged to the hirer. It is the hirer’s responsibility to check the condition of the equipment on delivery, and bring to the attention of a Tamworth Inflatables employee any issues regarding it’s condition at that time

 

 

CANCELLATION

·         There is no charge for cancellation prior to the day of hire.

·         Tamworth Inflatables promise to call all hirers the day before a booking to confirm times for delivery. If the weather forecast is bad, we will offer the option of cancelling at this time for no additional charge. However, if we arrive to set up the equipment, the full rental charge will be payable by the hirer. Any discounts or refunds will be entirely at the discretion of Tamworth Inflatables

 

 

SUITABILITY OF SITE AND ACCESS

The hirer will provide the following site conditions

·         A grassy level site for all equipment supplied. We will not set up our equipment on concrete, tarmac, gravel, shingle etc. Please do not cut grass within 3 days of hire, as grass cuttings will incur additional cleaning costs, which will be charged to the hirer

·         A minimum access width of 3 ft

·         Ensure that the site is free from all debris, sharp objects, and animal waste and within 50 metres of the delivery vehicle. If the site is outside of this distance, the hirer will provide an adult person to assist in the setting up and packing away of all equipment. If no person is available at the event, an additional charge of £50 may be levied against the bond at the discretion of Tamworth Inflatables

If the above conditions are not met, Tamworth Inflatables reserves the right to refuse delivery of the equipment, and to charge you the full rental price.

 

·         The hirer is required to provide access to a working and tested 240-volt 13amp power supply within 40 metres of the site. Each separate inflatable booked will require its own connection from the inflatable to the 240-volt 13amp wall socket. If the unit is hired with a petrol compressor, the additional charge made is for the hire of the petrol compressor and is supplied on the basis of being unfueled

 

·         Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded

·         The hirer is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event

·         Tamworth Inflatables reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or hirer’s conduct endangers the safety of the guests, hirer, or the safety of the hired equipment. At no time will any level of abuse against our staff be tolerated. In all such cases no refund will be given and full contracted fees will be due to Tamworth Inflatables

·         Any equipment hired for use on licensed premises shall be operated in a fenced off, glass free area. Notices indicating that the area is a GLASS FREE ZONE will also be required

 

SAFETY

The hirer is responsible for injury or damage occurring whilst the equipment is on hire and you are strongly advised to ensure you have adequate insurance to cover the use of bouncy castles whilst it is on hire to you

 

You must ensure that there is adequate adult supervision AT ALL TIMES when the castle/unit is in use.  An adult is defined as being over the age of 17

 

·         The Hirer is responsible for the safe keeping of the Bouncy Castle / unit and you will be charged for any damage caused to it or for any items missing on its return

·         The castle cannot be left unattended, and if hired overnight, the unit and all the accessories are to be stored indoors

·         Extreme caution is to be taken when handling extension cables and the electric blower. These will be positioned towards the rear of the inflatable and under no circumstances are children to touch these items. THE BLOWER IS NOT TO BE COVERED WITH ANYTHING

·         This inflatable is suitable for ages up to ______________. Under no circumstances should people older than this use the inflatable. If a child is taller than the side walls, they must not use the inflatable

·         The maximum number of children allowed on this inflatable at any one time is ___________. Try to avoid large children and small children using the inflatable at the same time. Some children require strict supervision

 

ADULT SUPERVISION IS NECESSARY AT ALL TIMES

 

·         All users must remove their shoes before using the bouncy castle, and users must be prevented from climbing up the walls / barriers of the castle

·         Food, drink, glasses, belts, toys, sharp instruments and pets are forbidden on all units

·         Supplied safety mats must be used

·         Do not move the castle, once it has been set up

·         Anchor points must be checked regularly during the hire period by the hirer to ensure castle is securely anchored to the ground

·         No Horse Play. Ensure children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others

·         Please ensure that Children are not attempting somersaults or acrobats and are clothed appropriately with empty pockets

·         Do not allow anyone to bounce on the front safety step as a Child could easily be bounced off the inflatable and get hurt. The step is there to assist users in getting on or off, not for bouncing on

·         Ensure that no-one with a history of back or neck problems is allowed on the Bouncy Castle or anyone who is feeling unwell

·         Do not allow anyone to be on the Bouncy Castle during inflation or deflation as this is DANGEROUS. Ensure that an area of 4 feet around the unit is completely clear

·         No face paints, party poppers, coloured streamers or silly string to be used either on or near the Bouncy Castle

·         No smoking or barbeques on or near the Bouncy Castle

·         The Bouncy Castle should not be used if it becomes wet on the jumping area. If no shower cover is fitted and in the event of rain, the unit should not be used

·         In the event of heavy rain, it is strongly recommended that the Bouncy Castle be switched off, and the blower covered with the supplied cover. DO NOT cover the blower when it is switched on.  Any wetness, including bubbling (which is normal) can be dried with a towel when the weather permits
In the event that the blower stops working, please ensure all users get off the inflatable immediately and contact
Tamworth Inflatables

·         If the Bouncy Castle is not being used for any part of the day, please switch the blower off at the mains

·         All badges, jewellery, (i.e. large earrings, necklaces etc.) MUST be removed

·         Climbing, hanging, or sitting on the walls is DANGEROUS and must not be allowed

·         Try to avoid large children and small children using the inflatable at the same time. Some children require strict supervision

 

DISCLAIMER

 

Please note that all persons using this Bouncy Castle do so at their own risk.

The person/s or organization hiring this Inflatable equipment will be responsible/liable for any damage or injury occurring from or as a result of misuse or reckless use.

These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are fully adhered to at all times. Tamworth Inflatables cannot accept any responsibility for any injury caused to anyone using this equipment.

 

I have read the above agreement and fully understand and accept the conditions as above. I am aware that whilst in my care I am fully responsible for the inflatable and will pay for any loss or damage that may occur - this will include the inflatable being returned in an unacceptable condition.

It is with regret that Tamworth Inflatables, due to recent incidents, are having to include this notice with all hires. We at Tamworth Inflatables take great pride in our safety standards and will not allow them to be compromised in any way. Please read and sign the following notice:

 

All inflatable equipment has an age limit for use; this is stated on your hire agreement and operating instructions. This limit is due to the manufacturing process, and if adults are allowed to use such equipment not specifically designed for them, their weight and size will compromise the safety of the inflatable.

Unfortunately it is becoming all too common that adults are still jumping on inflatables not designed as 'adult castles' whilst they are in their care, thus increasing the possibility of the inflatable being unsafe for the next hirer.

We are sure that you would not wish us to supply you with an unsafe castle for your children's party. With that in mind the next hirer deserves the same safety standards as you would expect. We do however realise that an adult may from time to time need to access the inflatable to deal with younger children, please keep this it to a minimum and spread your weight across the inflatable as much as possible.

We have specially designed 'Adult Castles' and should adults want to use the castle please hire one of these.

All our inflatables are put through a rigorous safety test at regular intervals, but if it is found that adults have used an inflatable not designed for them, then it must be retested to ensure that it is safe for the next person to hire for their children. Therefore if it is found that adults have used a children’s inflatable whilst it is in your care there will be an initial charge of £70 to have the inflatable retested, and you will be liable for the full cost of any repairs required due to the misuse and any loss of business whilst the inflatable is out of use.

 

I have read the above document and fully understand and accept the conditions above. I am aware that whilst in my care I am fully responsible for the inflatable and if it is found that adults have used the inflatable I will be liable to pay for a new safety test, the cost of repair for any damage and any loss of business due to such misuse of the equipment.
